Here are some basic tips for the practitioner:

  1. When you get a client, find out what he/she has been charged with. This seems like basic stuff, but with all the similar statutes out there, don’t assume that you know what the elements are. Look up the statute. If you don’t have Lexis or Westlaw or access to the statute books, here’s Title 53a, Title 21a (drug offenses) and Title 14 (DUI statutes).
  2. Then perform an elements analysis: Man bites dog at night.
