The bill has over two dozen amendments to sort through and has yet to be marked-up in committee. Additionally, there is some thought that the prosecutors' lobby wanted this bill to pass in time for the annual executioner's ball which was held a few days ago. With Roberts nomination now sucking all the time out of the judiciary's schedule this bill is no longer the one to worry about, there are more draconian habeas stripping bills coming down the pike including a particularly nasty one attached to various versions of the "sexual predator" legislation.
